At HIMA Benelux asbl we value your privacy. 
We respect and protect your privacy and believe it is important that you feel comfortable on our website, online diary and during our healthcare services. We therefore want to inform you in an open and transparent way about the use of your personal data and data related to your medical record.

1. Why this privacy statement?

Through this privacy statement, we give you an insight into what information we have collected about you. As soon as you visit our website, book an appointment (by phone or online) and use our services, you inevitably share personal data with us. For example: name, date of birth, address, contact details, IP address and medical data.

Through these personal data, we have the ability to start identifying you as a natural person. You are identifiable as soon as we can establish a direct or indirect link between one or more personal data and you as a natural person. Of course, this is really necessary for the type of service provided, namely care provision.

We promise to collect and use your personal data only within legal limits in accordance with AVG (Regulation 2016/679).

2. Who does your personal data end up with? 

2.1. Controller

HIMA Benelux is ‘controller’ in GDPR. Specifically, this means that we only determine what personal data is collected, for what purposes we collect that personal data and by what means we will process that personal data.

2.2. Processor(s)

As a controller, we are free to engage so-called ‘data processors’. A processor is a natural person or legal entity that processes personal data at the request of or on behalf of the controller. The processor always acts in accordance with the instructions of the controller.

HIMA Benelux relies on the following categories of processors:

  • Companies/organisations we have engaged for marketing purposes;
  • Companies/organisations we have engaged for hosting purposes;
  • Companies/organisations we have engaged for administrative purposes;
  • Companies/organisations we have engaged for membership management;
  • Companies/organisations we have engaged for customer management;
  • Companies/organisations we have engaged for communication purposes;
  • Companies/organisations we have engaged for security purposes;
  • Companies/organisations we have engaged for accommodation, transport and tourism services;
  • Authorities: we disclose personal data to law enforcement to the extent required by law, or strictly necessary for the prevention, detection and prosecution of crimes and fraud, or if we are otherwise required by law to do so. We may also disclose personal data to authorities to protect our rights and property, or the rights and property of our business partners.

All the processors listed above are obliged - under the GDPR - to ensure the security and confidentiality of your personal data. A processing agreement has been concluded with all our processors.

3. Which data do we collect?

 

We will only process those personal data that we really need to achieve the purposes for which we process them (see also Article 4).

We process the following categories of personal data:

 

  • Personal identification data
    (name, first name, date of birth, national register number, address);
  • Contact details
    (telephone number and e-mail address);
  • Financial identification data (bank details);
  • Electronic identification data (IP address, cookies);
  • Family composition;
  • Personal data of others that you provide to us;
    (We must remind you that it is your responsibility that the people whose personal data you have provided are aware of this and understand and accept how HIMA Benelux uses their information (as described in this Privacy Statement).

 

We collect this personal data when you use our this or other HIMA Benelux-owned websites or when you use our services. How much, often and what data we collect depends on certain services you use.

We also use cookies to recognise visitors to our website and provide them with a personalised user experience, to remember their technical choices (e.g. a language) and to detect and correct any errors on the website. Questions about our cookie policy ? Then be sure to read it on our website.

4. Why do we need you personal data?  

We collect your personal data to provide you with an optimal, safe and personalised user experience. As you make more intensive use of our website and our service and care services, we will also collect more personal data. We have the right to temporarily not carry out or completely cancel certain processing operations if your personal data is missing, incorrect or incomplete.

Processing personal data is essential for the operation of our website and the related service and care provision.

We will only process personal data for the following well-defined purposes:

Customer management: customer administration, order management, deliveries, invoicing, credit check, support, complaint monitoring, personalised marketing and advertising and sending newsletters.

If you visit our website, we may also collect some data for statistical purposes. We need this data to optimise the use of our website. For example: likely place of consultation, hour and day of consultation, which pages were visited. When you visit the website, you agree to the data collection for statistical purposes as described above.

You always choose whether to share personal data with us. In this way, you have a certain amount of control. If certain personal data are incomplete or apparently incorrect, we have the right to temporarily or permanently postpone certain expected actions.

5. Transfer personal data?  

Your personal data will be processed for internal use within HIMA Benelux. We can also reassure you that we will never sell, transfer or communicate your personal data to third parties, except if you have given us your explicit consent in advance or if there is a legal obligation to do so.

6. Retention personal data?  

We will keep your personal data for as long as necessary to achieve the purposes set out in Article 3. We will delete your personal data from our database as soon as we no longer need it to achieve these purposes or when you validly exercise the right to delete your personal data.

7. What are your rights? 

7.1 Guarantee of lawful and secure processing

Your personal data will always be processed for legitimate purposes, as set out in Article 3. They will be collected and processed in an appropriate, relevant and proportionate manner, and will not be kept longer than necessary to achieve the stated purposes.

7.2 Right of inspection 

If you prove your identity (e.g. by providing a copy of your identity card), we will be happy to inform you exactly what personal data we hold on you and what we do with that information.
The right to inspection is free of charge.

7.3 Right of removal

You have the right to obtain the deletion of your personal data, in the following cases:

  • When we no longer need your personal data for the intended purposes;
  • When you withdraw your consent to the processing of your personal data and there is no other legal basis allowing the processing of your personal data;
  • When you have legitimately lodged an objection to the processing of your personal data;
  • When your personal data are processed unlawfully;
  • When we have to delete your personal data based on a legal obligation.

Please note that in certain cases we have no choice but to keep your personal data for a certain period of time, even though you might prefer to be 100% deleted from our database. We are required by law to keep invoices, for example, for 7 years.

7.4 Right of rectification

If the information we have about you is incorrect or incomplete, we can always correct it at your request. If certain personal data (e.g. your e-mail address or telephone number) are no longer up-to-date, please inform us.

7.5 Right of restriction

In some cases, you have the right to request that we restrict the processing of your personal data. This applies, for example, if there is a dispute regarding the accuracy of the data, if the data is necessary in the context of legal proceedings or during the time necessary for HIMA Benelux to establish that you can validly exercise your right to erasure.

7.6 Right to object

You have the right to object at any time to the processing of your personal data for direct marketing purposes, profiling purposes or purposes arising from our legitimate interests. We will no longer process your personal data unless we can demonstrate that there are compelling legal reasons that override your right to object.

7.7 Right of data portability

You have the right to receive the personal data you have shared with us in a digitally readable standard format. In addition, you may transfer that personal data yourself or have us transfer it to another controller, unless this is technically impossible.

7.8 Right of withdrawal of your consent 

You have the right to withdraw your consent at any time, for example if you have given it for direct marketing or profiling purposes.

8. How to excercise your rights? 

If you wish to exercise any of the above rights, you may send a written request and proof of identity by letter to HIMA Benelux VZW, Willem Klooslaan 10 bus 5 , 2050 Antwerp . We promise to respond to your request no later than 1 month after receipt.

9. Possibility to file a complaint 

9.1 Data protection authority
